Pending counsel review. "We" in this document is Medelix, currently operated by Melih Yaz as an individual in Vienna, Austria.
By using Medelix you agree to these Terms. If you do not agree, do not use the service.
These Terms are written to be readable by a non-lawyer. The summary box at the top of each section is non-binding; the rest of the section is the binding text.
1 · Who we are
Summary: Medelix is currently operated by Melih Yaz as an individual based in Vienna, Austria. We're building a tool for European doctors and medical students.
Service: Medelix (medelix.ai). Currently operated by: Melih Yaz as an individual based in Vienna, Austria ("we", "us"). References to "we", "us", or "Medelix" in these Terms include any future legal entity established to operate the service.

2 · What Medelix is — and what it isn't
Summary: Medelix retrieves medical evidence from peer-reviewed and open-access literature and shows you the citations. It is not a medical device, not clinical advice, and not a substitute for professional judgment. You are responsible for any clinical decisions you make.
Medelix is an evidence-retrieval tool. You ask a medical question; Medelix searches public scientific literature (currently EuropePMC, with additional open-access sources planned) and returns an answer that summarises what the literature says, with citations to the underlying sources.
Medelix does not:
- Constitute medical advice, diagnosis, or treatment.
- Reason about specific patients.
- Replace your professional judgment, your training, or consultation with a qualified clinician.
- Hold any medical-device certification (CE mark, FDA clearance, etc.).
You are responsible for verifying every cited source and for any clinical or operational decisions you make. Always consult primary sources and qualified clinicians before acting on information surfaced by Medelix. Medelix may produce inaccurate, outdated, or incomplete summaries; the citations are the authoritative reference.
If you face a medical emergency, contact your local emergency services (in the EU: 112). For mental-health crisis support, see Section 11.
3 · Eligibility and professional-user framing
Summary: You must be 18+ and using Medelix for legitimate medical research, education, or professional purposes — not as a consumer.
You must be at least 18 years old to create an account or use the service. By using Medelix you confirm that you are using it for professional medical, research, or educational purposes — not as a consumer in the sense of §1 KSchG (Austrian Consumer Protection Act). Medelix is a professional clinical-literature tool aimed at qualified medical practitioners and medical students; it is not a consumer health service.
We may, but are not required to, verify professional credentials. Statements you make about your professional status do not change the service we provide; they do, however, define the contractual framework that applies (Sections 9 and 10 below).
If, despite the above, mandatory Austrian or EU consumer-protection law applies to you, nothing in these Terms limits the rights you have under that law.
By accepting these Terms, you affirmatively represent that you are using the service for purposes that fall outside §1 KSchG (Austrian Consumer Protection Act), and you agree that the Section 10 limitations apply to the maximum extent permitted given your professional-user status.
4 · Your account
Summary: Keep your password and devices secure. You're responsible for activity on your account.
You may create an account using email and password, "Sign in with Google", or "Sign in with Apple". You agree to:
- Provide accurate information during sign-up.
- Keep your credentials secret and not share your account.
- Notify us promptly at [email protected] if you suspect unauthorised access.
- Use only one account per person, unless we agree otherwise in writing.
We may suspend or terminate accounts that violate these Terms (Section 6) or that we suspect are involved in fraud, abuse, or unauthorised access.
5 · What you can put into Medelix
Summary: Don't enter patient-identifying information. Don't try to make Medelix behave outside its intended purpose.
You agree not to:
- Enter any information that could identify a real patient — names, dates of birth, addresses, photographs, MRNs, or any combination that could re-identify someone. Phrase questions abstractly ("a 65-year-old with...") rather than with patient data.
- Enter information you do not have the right to share.
- Submit content designed to circumvent safety measures, manipulate the model, or extract system instructions.
- Attempt to extract, scrape, or reverse-engineer the underlying model, the retrieval cascade, or any sub-processor's content beyond what is provided through the documented interface.
- Use Medelix to plan or facilitate harm to yourself or others, to obtain instructions for synthesising controlled substances for non-medical use, or to obtain operational guidance for any unlawful activity.
- Use the service for high-stakes automated decisions about real patients.
If you input patient-identifying data despite this prohibition, you remain responsible for that data under the GDPR as the original controller; we will treat it as personal data of yours and apply our usual security and retention measures, but the cleanest course is for you to delete the conversation immediately and re-ask without identifiers.
You acknowledge and agree that you act as the data controller, within the meaning of GDPR Art. 4(7), for any personal data of third parties (including patients, colleagues, or any other identifiable individual) that you enter into the service, regardless of whether such entry violates these Terms. Medelix acts solely as a processor for the technical handling of any such input. You are responsible for establishing a lawful basis under Art. 6 and, where applicable, Art. 9 GDPR for any personal data you input, and for fulfilling all controller obligations (transparency, data-subject rights, breach notification, etc.) toward the individuals concerned. You agree to indemnify Medelix against any claim arising from inputs that fail to meet these requirements (see Section 10a). To reduce the risk of accidental input, Medelix applies automated pattern-matching at the input layer to detect and redact common direct identifiers; this is a technical safeguard and does not relieve you of your controller obligations.
6 · Service availability
Summary: Medelix is in research preview. We may change, pause, or end features. We aim for high availability but don't guarantee it.
Medelix is currently a free Research Preview Open Beta. We may add, change, or remove features, models, or sub-processors. We may rate-limit, throttle, or temporarily suspend service for maintenance, capacity, or abuse prevention.
We aim for high availability but do not guarantee uninterrupted service. The service is provided "as is" and "as available" to the extent permitted by law. Specifically, and without limitation:
- The literature corpora we search are external; their availability and accuracy is outside our control.
- Model providers (Mistral, future others) may experience downtime.
- Network failures, scheduled maintenance, or security responses may interrupt the service.
The Research Preview is provided without any service-level commitment. We do not guarantee any uptime, latency, throughput, or response quality.
7 · Pricing
Summary: Free during research preview. We will tell you in advance before introducing any paid tier.
During the Research Preview Open Beta, Medelix is free for everyone. We will announce pricing at least 30 days before introducing any paid tier, and any data you uploaded during the free period remains yours; you can export or delete it before any pricing change applies.
Daily question caps may apply for fair use; we will tell you in the interface when you approach a cap.
8 · Intellectual property
Summary: We own Medelix. You own your questions and the conversations you create. Citations point to third parties; we don't claim rights over their content.
Our property. The Medelix software, brand, and design are owned by us. You receive a limited, non-transferable, revocable licence to use the service for the purposes described in these Terms.
Your content. You retain ownership of the questions you submit. You grant us a non-exclusive, worldwide, royalty-free licence to process them as necessary to provide the service (including transmitting them to sub-processors as listed in the Privacy Policy). This licence ends when you delete the relevant data or your account, except where we are legally required to retain it.
Generated answers. Medelix's outputs are derived from public literature plus model summarisation. We do not claim copyright over outputs themselves; whether an output is independently copyrightable depends on jurisdiction. You may use outputs for your own internal research and educational purposes, subject to the licensing terms of any cited source.
Cited sources. Citations point to third-party works (papers, guidelines, abstracts). The rights in those works belong to their respective publishers and authors. We do not redistribute full text under licence we don't have; for full text you should follow the citation links.
Feedback. If you send us suggestions or bug reports, we may use them to improve Medelix without restriction or compensation.
9 · Disclaimers
Summary: No warranties beyond what the law mandates. Medical decisions are yours.
To the maximum extent permitted by law:
- The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
- We do not warrant that the service will be uninterrupted, error-free, or secure, or that defects will be corrected.
- We do not warrant the accuracy, currency, or completeness of any answer or citation. Medelix may produce errors. Always consult primary sources before clinical action.
- Medelix is not a medical device and provides no medical advice. Reliance on Medelix for clinical decisions is at your own risk.
Where mandatory consumer-protection law applies (and you are a consumer in the EU), nothing in these Terms limits or excludes warranties or rights you have under that law.
10 · Limitation of liability
Summary: We are responsible for serious fault; we cap routine liability and exclude consequential damages. We are never responsible for medical decisions you make using Medelix.
To the maximum extent permitted by Austrian and EU law:
- We are liable for intent and gross negligence (§ 1294 ff. ABGB), under Austria's Produkthaftungsgesetz (PHG, BGBl. Nr. 99/1988) where it applies, for personal injury caused by a breach of our duties, and where we have given an express guarantee.
- For breaches of essential contractual duties (cardinal duties — those whose fulfilment is necessary for the proper performance of the contract and on which you may reasonably rely) caused by ordinary negligence, our liability is limited to typical, foreseeable damages.
- All other liability for ordinary or slight negligence is excluded.
- Liability cap: to the extent permitted by law, our aggregate liability for any and all claims arising out of or in connection with the service in any 12-month period is capped at the higher of (a) the fees you actually paid for the service in the prior 12 months (during the Research Preview this is €0) or (b) €100.
- No consequential damages: within the limits of applicable mandatory law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation lost profits, lost data, business interruption, loss of goodwill, or substitute-service costs.
- No medical-decision liability: we are never liable for any clinical decision, diagnosis, treatment outcome, medication choice, or harm to any patient arising from your use of Medelix or your reliance on outputs. Medelix is an evidence-retrieval tool, not a medical device; clinical responsibility rests entirely with you and the qualified professionals involved.
- Third-party services: we are not liable for losses arising from the actions, outages, content, or accuracy of sub-processors (Section 5 of the Privacy Policy), external literature corpora, model providers, or hosting providers.
These limits do not affect statutory liability that cannot be excluded under Austrian or EU law — in particular mandatory consumer-protection rights under the KSchG (where you qualify as a consumer despite Section 3), liability for personal injury caused by our negligence, and liability under the PHG.
10a · Indemnification
Summary: If you cause us a legal problem by misusing Medelix, you cover the cost.
You agree to defend, indemnify, and hold harmless the operator from and against any third-party claims, liabilities, damages, losses, and reasonable legal costs arising out of or related to:
- Your input of patient-identifying data into the service despite the prohibition in Section 5;
- Your reliance on Medelix outputs for clinical, diagnostic, treatment, or operational decisions about real patients;
- Your breach of these Terms or of any law applicable to your use of the service;
- Your infringement of third-party rights (including intellectual-property or privacy rights) through your use of the service.
This indemnification obligation survives termination of your account.
10b · Force majeure
We are not liable for any failure or delay in performance caused by events outside our reasonable control, including without limitation: outages of model providers (Mistral, Jina), hosting providers (Supabase, Railway, Netlify, Cloudflare, Brevo, Plausible), external literature corpora, the wider internet, governmental or regulatory action, court orders, natural disasters, war, civil unrest, labour disputes, or other circumstances of comparable severity. Where reasonable, we will work to restore service as soon as practicable.
11 · Crisis support
Summary: If you are in a mental-health crisis, please reach out — Medelix is not built for that.
Medelix is a literature-retrieval tool, not a crisis-support service. If you or someone you know is in mental-health distress or thinking about suicide or self-harm, please contact a crisis service:

If our system detects that you are expressing crisis, it will surface these contacts and decline to retrieve literature; this is intentional.
12 · Termination
Summary: Either side can end this. We can suspend if you violate the rules.
You may delete your account at any time from Settings → Privacy. We may suspend or terminate your account where:
- You materially violate these Terms (especially Section 5).
- We are required to do so by law or supervisory authority.
- We reasonably believe your account is involved in fraud, abuse, or security incidents.
On termination, your account data is deleted within 30 days, except for (a) security event logs retained 24 months for fraud prevention and legal-defence purposes, and (b) data we are legally required to retain. Detailed retention periods per data category are in §4 of the Privacy Policy.
13 · Governing law and jurisdiction
These Terms are governed by Austrian law, without regard to its conflict-of-laws rules. The exclusive place of jurisdiction for disputes arising from or in connection with these Terms is Vienna, Austria, to the extent permitted by law. Mandatory consumer-protection forum rules under Austrian and EU law remain unaffected — where you qualify as a consumer despite Section 3, you may also bring proceedings in the courts of your EU member state of residence.
14 · Changes to these Terms
We may update these Terms. Material changes (changes that affect your rights, our obligations, or the service in a meaningful way) will be communicated by email and will take effect no sooner than 30 days after notice. Non-material changes (clarifications, typo fixes, sub-processor list updates) take effect on the "Last updated" date shown above.
If you do not agree with material changes, your remedy is to stop using the service and delete your account.
15 · Severability
If any provision of these Terms is held invalid or unenforceable, the rest of the Terms continue in effect. The invalid provision will be replaced by an enforceable one that comes closest to the original intent.

By creating an account or using Medelix, you confirm that you have read and agree to these Terms and to the Privacy Policy.
